200 CADILLACS SWEEPSTAKES
Image Entertainment release "200 Cadillacs" presents the 200 Cadillacs Online Sweepstakes (“Sweepstakes”) sponsored by Image Entertainment, 9333 Oso Avenue, Chatsworth, California 91311. The Sweepstakes begins at 12:00:00pm (PDT) on Monday, November 24, 2003, and ends at 11:59:59 p.m. (PDT) on Friday, January 9th, 2004 (“Sweepstakes Period”)
1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING.
2. ELIGIBILITY. United States and California law governs this Sweepstakes. From time of entry through the final date of prize fulfillment, each Sweepstakes entrant and winner must be a permanent legal resident and citizen of the forty-eight (48) contiguous United States and the District of Columbia, exclusively, who reside and are physically located in the U.S. and are eighteen (18) years of age or older. All applicable federal, state and local laws and regulations apply. Void where prohibited or restricted by law. Employees, officers, directors, agents, and representatives of Image Entertainment Inc., 200 Cadillacs, Inc., Elvis Presley Enterprises (EPE), and Mintek, their respective parent companies, affiliates, subsidiaries, advertising and promotion partners and any entity involved in the development, production implementation, administration, or fulfillment of this Sweepstakes, and their immediate family members and persons living in the same household (whether or not related) of such individuals are not eligible to participate or win. Only one winner per household. All decisions of the Sponsors with respect to this Sweepstakes are final.
3. HOW TO ENTER: You may enter the Sweepstakes in either of the following ways:
Online: Access the Sweepstakes page via the World Wide Web by logging on to 200cadillacs.com (http://www.200cadillacs.com) or via a link from official/authorized e-mail invitations. Click on the sweepstakes icon and go to the Sweepstakes promotion page within the 200 cadillacs web site window. Click through to the Sweepstakes registration page, enter, in the spaces provided, your first and last name, street address (P.O. Box addresses not accepted), city, state, zip code, daytime telephone number, date of birth and e-mail address and click on the "Submit" button to forward your entry into the Sweepstakes. Participants will be given the opportunity to opt-in to receive future information, offers and promotions, via e-mail, about 200 Cadillacs and Elvis.com.
By mail: On a U.S. Postal Service-approved postcard (minimum size 3 1/2" x 5") or a piece of paper, hand-print your first and last name, street address (P.O. Box addresses not accepted), city, state, zip code, daytime telephone number, date of birth and e-mail address (e-mail address not necessary to enter) and mail to Image Entertainment 200 Cadillacs Sweepstakes, 9333 Oso Ave, Chatsworth, CA 91311. Each mail entry must be mailed separately.
Participants may enter, either online or by mail, only once per day. Limit one entry per person/household/e-mail address, regardless of method. All online entries must be received and all mail entries must be postmarked no later than 11:59:59 p.m. (PDT) on Friday, January 9, 2004 . The Administering Agency must receive all mail entries no later than 11:59:59 p.m. (PDT) on Monday, January 16, 2004. A "day" for the purpose of the Sweepstakes is a 24-hour period that begins at 12:00:00 a.m. (PDT) and ends at 11:59:59 p.m. (PDT). Double entries will not be accepted.
Incomplete, illegible, false or deceptive entries are void. In the event of a dispute about the identity of an entrant (via entry online), each entry will be declared made by the authorized account holder of the email address submitted at the time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet Service Provider, online access provider, or other organization (i.e. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. With respect to the winning entry (if such entry was an online entry), the winner may be required to provide proof that the winner is the authorized account holder of the email address associated with the winning entry.
4. SELECTION OF WINNERS. Five (5) Winners will be selected by random drawing conducted by the Sponsor on a weekly basis, beginning Monday, December 1, 2003 and on each following Monday through Monday, January 12, 2004. Sponsor's decision will be final. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, problems or technical malfunction of any telephone network or circuits, computer online systems, servers or providers, computer equipment, software, failure of any e-mail, theft, or destruction or unauthorized access to, or alteration of entries. To obtain a copy of the official rules or the winner's list by mail, send a self-addressed, stamped envelope with your complete name and address (no P.O. Boxes) to "200 Cadillacs Sweepstakes" c/o Image Entertainment official rules request – 9333 Oso Ave, Chatsworth, CA 91311. Rules request must be received by January 9, 2004. Vermont residents may omit postage for rules request. Not responsible for lost, misdirected, late, stolen, garbled, illegible or postage due entries or requests. No automated or mechanical entries permitted, or those by third party or sweepstakes subscription service.
Winner Selection and Notification - One (1) Grand Prize winner will be picked in a random drawing from all eligible online and mail-in entries by Sponsor or its agent, on or about January 19, 2004. Winner will be notified by phone, email, or mail and will be required to complete, execute, and return an affidavit of eligibility and liability/publicity release. Failure by a selected entrant to respond to such notification within a reasonable time frame, as determined by Sponsor in Sponsors absolute and sole discretion, will result in disqualification of the selected entrant. The return of selected entrant’s notification, prize information, or the prize as undeliverable will result in disqualification of the selected entrant. Upon any such disqualifications, an alternate Sweepstakes entrant shall be selected by random drawing conducted by Sponsor. - Thirty-Five (35) Second Prize winners will be picked in seven (7) random drawings conducted on a weekly basis beginning Monday December 1, 2003 and on each following Monday through Monday, January 12, 2004. Each of the seven (7) weekly drawings will be picked by random from the
Previous week’s entries. – Ten (10) Third Prize winners will be picked in a random drawing from all eligible online and mail-in entries by Sponsor or its agent, on or about January 19, 2004.
One Grand Prize - One (1) Grand Prize winner will receive one state of the art Mintek DVA 8700 Home Theatre System. Color, style, and any options are at the sole discretion of Sponsor. Value of Grand Prize $1,000.00. Thirty-five (35) Second Prize winners will receive one “200 Cadillacs DVD” and one “200 Cadillacs Soundtrack" CD. Value of Second Prize $35.99. Ten (10) Third Prize winners will be awarded with a 1-year free membership to the Official Elvis Collector’s Club. Value of Third Prize $29.95.
Entry into the Sweepstakes is your promise and warranty that you are eligible to participate in this Sweepstakes, and accept decisions of the sponsor as final. Sponsor is not responsible for any inability of the Winner to accept the Grand Prize for any reason. Entries become the property of the Sponsor and will neither be acknowledged nor returned. All entries are subject to verification prior to awarding of prizes. Eligibility, age, and claims made by prizewinners are also subject to verification prior to awarding of prize
5. ODDS OF WINNING. Odds of winning will be dependent on number of eligible entries received. Purchase will not increase the odds of winning
6. LIABILITY RELEASE. By participating in the Sweepstakes, entrants release Image Entertainment, EPE, Mintek, and 200 Cadillacs, Inc. their respective parent companies, affiliates, subsidiaries, franchisees, and all of their advertising, promotional and production agencies, and each of their officers, employees, directors, shareholders, and agents (collectively, "Releases") from any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred and including, without limitation, property damage, personal injury and/or death which may occur in connection with acceptance and/or use of the prize or by or while participating in this sweepstakes or traveling to any prize related activity. Winner also consents to the use of his/her name, voice, likenesses and/or photograph for advertising and publicity purposes for this and similar promotions without additional compensation or permission, except where prohibited by law. Decisions of the Sponsor are final and binding.
Releases disclaim any and all liability for technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, line failures of any telephone network, computer equipment or software, inability to access any web site or online service, or any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes, or any other technical or other error or malfunction. If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper entry for this Sweepstakes and processing of entries per these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, action by entrants, fraud, technical failure, or any other cause, in Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action, and/or to cancel, terminate, modify or suspend this Sweepstakes or any portion thereof. If this Sweepstakes is so terminated, Sponsor will select potential winner from among all eligible, non-suspect entries received until the action requiring such termination. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of the winner of a potentially wining internet entry, entry will be deemed made by the authorized account holder of the e-mail address associated with the potentially winning entry, as solely determined by Sponsor.
7. RESTRICTIONS. Sponsor shall not be liable to winners for failure to supply the prize or any part thereof, by reason of any Force Majeure Act (including but not limited to acts of God, any actions regulations, orders or requests by government agencies, terrorist acts etc.).
By participating in the Sweepstakes, participants acknowledge their understanding, compliance and acceptance of the terms of the Official Rules and agree to be bound by the Official Rules and the final decision of the Sponsor and the Administering Agency. Sponsor is not responsible for fraudulent calls or emails made to entrants not by the Sponsor.
8. ARBITRATION. Except where prohibited by law, as a condition of participating in this Sweepstakes, entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office in Los Angeles, CA; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, or consequential damages , or any other damages, including attorney’s fees. Entrant further waives all rights to have damages multiplied or increased. California law shall be applied in the arbitration.
